ABSTRACT:The extension of human rights obligations to corporations raises questions about whose rights and which rights corporations are responsible for. This paper gives a partial answer by asking what legal rights corporations would need to have to fulfil various sorts of human rights obligations. We should compare the chances of human rights fulfilment (and violations) that are likely to result from assigning human rights obligations to corporations with the chances of human rights fulfilment (and violations) that are likely to result (...) from giving corporations the legal rights needed to undertake those human rights obligations. Corporations should respect basic human rights of all people. Non-complicity in human rights violations requires that corporations have the right to political freedom of speech. To actively protect people from human rights violations, corporations need the right to hire armed security personnel; such obligations should be limited to protecting corporate property and narrowly defined stakeholders. Obligations to spend corporate resources on human rights fulfilment are confined to contributing to specific projects. Corporations have no obligation to ensure a society in which human rights are fulfilled. This principle helps us understand why corporate obligations are substantially different from those of governments. (shrink)

This article develops contractarian business ethics by applying social contract arguments to a specific question: What are the pre-legal (or moral) rights and responsibilities of corporations? The argument uses a hypothetical social contract to show the existence of for-profit corporations in democratic capitalist societies is consistent with Rawls’s fundamental principles of justice. Corporations ought to have recognised their rights to be autonomous, to pursue private purposes, and to engage in economic activities. Corporations have a responsibility to respect the freedom and (...) human rights of all people, and not to interfere with government programs that ensure people have the education and training they need to find and keep corporate employment and that provide a safety-net that prevents destitution. If corporations have any other rights and responsibilities, those rights and responsibilities need to be established by actual social contracts, probably in the form of legitimate democratic processes. Abstract:Discussions of the ethics of advertising have been based on a general distinction between informative and persuasive advertising without looking at specific techniques of persuasion. Self-identity image ads persuade by presenting an image of an idealized person-type such as a “beautiful” woman (Chanel) or a sexy teen (Calvin Klein). The product becomes a symbol of the ideal, and target consumers are invited to use the product to project the self-image to themselves and others. This paper argues that image ads are (...) not false or misleading, and that whether or not they advocate false values is a matter for subjective reflection. Image ads can undermine a consumer’s self-esteem by collectively omitting images authentic for that sort of person (such as large women), and by combining impossible images with implied gaze. Image ads generally do not undermine autonomy of choice, internal autonomy, or social autonomy. It is concluded that image advertising is a basically ethical technique, but several recommendations are given on how use of image advertising can avoid specific harms. (shrink)

James Tully and others have argued recently that the theory of property Locke defends in the Second Treatise was designed to justify European settlement on the lands of North American Natives. If this view becomes generally accepted, and Tuck suggests it will be, doubts may arise about the impartiality of Lockean property theories. Locke, as is well established and documented again by Tully, had huge vested interests in the European settlement of North America and possibly in the enslavement of Native (...) Peoples. Doubts about Locke may reflect on all rights theories of property and thus bring into question ‘one of the major political philosophies of the modem world’. Raising these doubts is part of Tully's declared intention. His article tries to show that the Native systems of property and government which Locke defines away as illegitimate are in fact interesting and potentially beneficial alternatives to Lockean individual rights theories. Marcoux argues that job candidates ought to embellish non-verifiable information on their résumés because it is the best way to coordinate collective action in the résumé ‚game’. I do not dispute his analysis of collective action; I look at the larger picture, which throws light on the role game theory might play in ethics. I conclude that game theory’s conclusions have nothing directly to do with ethics. Game theory suggests the means to certain ends, but the ethics of both the (...) means and ends must be assessed separately before any ethical recommendation can␣be made. Marcoux makes several highly disputable assumptions in order to fit résumés into game theory; his analysis does not take into account the consequences that embellishing has beyond the submission and assessment of␣résumés; his argument depends on his claim that a résumé system in which everyone embellishes is attainable; and finally, his argument relies on an idealization of human␣motivation, rather than abstraction. . Trans-National Corporations (TNCs) pay relatively high salaries to local people in host countries. TNCs assume that such employees will accept an employeeÇôemployer relationship similar to that which exists in North America, but the obligations and personal interests that such a relationship create often directly conflict with systems of obligation already established in the host country. When TNCs do business across the boundaries of systems of obligation, corporate salaries can be seen as a form of unethical bribery. In this paper, (...) the core case of business bribery is described consistent with the usual philosophical analysis of bribery, and the grounds for thinking bribery is unethical are made clear. The amount of a bribe is irrelevant to the ethical analysis. Bribery is distinguished from tips and grease on structural grounds. The concept of a system of obligation is defined, and examples given that show the variability of systems of obligation in host countries. Arguments are given to show that salaries paid by TNCs create obligations and personal interests which sometimes conflict with existing systems of obligation, and that such payments have the same structure as more traditional forms of bribery. The ethical issues of corporations crossing the boundaries of systems of obligations are discussed. (shrink)

This book explores the intimate connections, conflicts and discontinuities between religion and philosophy in the Platonic and Neoplatonic traditions from Antiquity to the early Medieval period. It presents a broader comparative view of Platonism by examining the strong Platonist resonances among different philosophical/religious traditions, primarily Jewish, Christian, Islamic and Hindu, and suggests many new ways of thinking about the relation between these two fields or disciplines that have in modern times become such distinct and, at times, entirely separate domains.

In his book Economics as a Moral Science , Bernard Hodgson argues that economics is not value neutral as is often claimed, but is a value-laden discipline. In the long argument for this in his book, Hodgson never discusses or even mentions corporations. This article explains that corporations are absent from Hodgson’s discussion because he considers only the consumption side of general equilibrium theory (GET), and it shows that if Hodgson had included corporations and the production side, his overall argument (...) would have been more complete and convincing. This article shows that Hodgson’s methodology, when applied to the production side of GET, has value implications for CEOs of large corporations, for shareholders and members of Boards of Directors, and for legislators and regulators of business. Hodgson’s claim that economics must consider the ability of economic agents to create or change the institutional, cultural, and organizational conditions of their own economic actions is supported and expanded. Spinoza’s claims about true ideas are central to the Treatise on the Emendation of the Intellect. It is therefore worth trying to reconstruct what he means when he says that an idea is true. I argue that the three leading interpretations – correspondence, coherence, and causal – don’t explain key passages. I then propose a new interpretation. Roughly, I propose that an idea is true if and only if it represents an essence and was derived in the right kind of (...) way by the intellect from an innate idea of one’s own essence. In the final section I sketch why I believe this interpretation extends to his claims about truth and adequacy in the Ethics. (shrink)

Western philosophy’s relationship with prisons stretches from Plato’s own incarceration to the modern era of mass incarceration. Perceptual Confidence is the view that our conscious perceptual experiences assign confidence. In previous papers, I motivated it using first-personal evidence (Morrison, 2016), and Jessie Munton motivated it using normative evidence (Munton, 2016). In this paper, I will consider the extent to which it is motivated by third-personal evidence. I will argue that the current evidence is supportive but not decisive. I will then describe experiments that might provide stronger evidence. I hope to thereby provide a roadmap for future (...) research. (shrink)

According to anti-atomism, we represent color properties (e.g., red) in virtue of representing color relations (e.g., redder than). I motivate anti-atomism with a puzzle involving a series of pairwise indistinguishable chips. I then develop two versions of anti-atomism.

I will develop a new problem for almost all realist theories of colour. The problem involves fluctuations in our colour experiences that are due to visual noise rather than changes in the objects we are looking at.

Conception and causation are fundamental notions in Spinoza's metaphysics. I argue against the orthodox view that, due to the causal axiom, if one thing is conceived through another thing, then the second thing causes the first thing. My conclusion forces us to rethink Spinoza's entitlement to some of his core commitments, including the principle of sufficient reason, the parallelism doctrine and the conatus doctrine.

Aquinas, Ockham, and Burdan all claim that a person can be numerically identical over time, despite changes in size, shape, and color. How can we reconcile this with the Indiscernibility of Identicals, the principle that numerical identity implies indiscernibility across time? Almost all contemporary metaphysicians regard the Indiscernibility of Identicals as axiomatic. But I will argue that Aquinas, Ockham, and Burdan would reject it, perhaps in favor of a principle restricted to indiscernibility at a time.

A satisfactory contextualist theory of knowledge must provide an account of how knowledge varies across contexts. There are three contextualist proposals for developing such an account. This paper demonstrates that all of them are unacceptable. Contextualists have therefore failed to provide a satisfactory theory of knowledge.
